PRIVACY POLICY

We assure you that we at Kashmir Treks take all reasonable measures to maintain your privacy and security regarding personal information that you voluntarily divulge to us. We take this seriously! During the course of communication with and registering customers, we collect information that you voluntarily disclose to us, including but not limited to name, address, phone and email. This information may come to us from an associated third party, such as a person who is the primary organizer or contact person for a group, or from a travel agent. KT may choose to retain such information in its data base. We may utilize, within company, such information for our occasional mailings, email notices or even phone calls for the purposes of advancing the program of KT.

However, we will not share or sell that information with any other company/entity for commercial purposes.

Furthermore, we will not collect from your personal computer or any other source, additional information about you beyond what you have voluntarily given to us.

There are some limited circumstances in which we may have to disclose your information: if required by law or if we are required to do so by law-enforcement authorities, or if we believe in good faith that the information you have provided us is necessary to disclose to the appropriate authorities for the protection of rights, property, or safety of our company and its users.

KT uses state of the art efforts to secure the confidentiality of your personal information. Unfortunately, internet security is not perfect. For example, third parties may unlawfully intercept or access transmissions or private communications. Please use appropriate caution before you disclose personal information to any internet site, and realize that some companies take insuring your privacy much more seriously than others.

ACCEPTANCE OF RISK

KT’s trek itineraries have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of personal risk and exposure to potential hazards over and above those associated with normal “package” holidays. The client acknowledges that the nature of the tour is adventurous and that such activities may involve a significant amount of personal risk. We advise to read and understand high altitude precautions.

INSURANCE

It is the client’s responsibility for obtaining sufficient personal travel insurance. The client is willing to accept full responsibility for insurance up to limits that the client may require. This insurance must cover personal accident, medical expenses, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury delay or inconvenience occurring to the client. It is compulsory that all clients have personal travel insurance. When obtaining travel insurance the client must ensure that the insurer is aware of the type of travel to be undertaken.

REFUND POLICY

Cancellation of the trek.

The cancellation charges are as under:
Cancellations prior to 30 days from the start of the trek — full refund.
Cancellation between 30 days and 20 days to the start of the trek — 50% refund.
Cancellation less than 20 days to the start of the trek — no refund.

PRICES AND SURCHARGES

As we publish our prices well in advance, we may occasionally be faced with significant cost increases due to factors over which we have no control. As such we reserve the right to impose surcharges (or price decreases) up to 1 day before departure due to increases in trek permits fee, increases in houseboat fares or transport costs, taxes, or if government action should require us to do so.
Our KT’s trek prices are based upon the following third party costs which are outside of our control: (info updated 01 March 2017)

1: Trek permit fee is 500 INR/person, government fixed rate for houseboat is 3600 INR per night for a deluxe double bed room, 900 INR for one pony per day. The government reserves the right to increase these charges at any time throughout the year and may only give us one or two weeks notice.

2: Included in the price of the trek is the two-way journey by a car from Srinagar airport to the houseboat on the Dal Lake and two-way journey by a car from houseboat to the base camp of the trek. The car fare from Srinagar airport to the houseboat is 800 INR for one-way and from 2200 INR to 3600 INR from houseboat to the base camp of the trek in Kashmir Valley for one-way based up on the distance from Srinagar to the base of the trek.

If any of the third party costs listed above change to increase the cost of the trek we will immediately update the trek price listed on our website. Clients will be liable for paying any increased cost of the trek.

AUTHORITY ON TOUR

At all times the decision of the company’s guide or representative will be final on all matters likely to endanger the safety and well being of the tour group. The client must at all times strictly comply with the laws, customs and drug regulations of Jammu and Kashmir State. Should the client fail to comply with the above, or should the client interfere with the well being of the group then the guide or company representative may order the client to leave the tour without recourse to any refund.

TRAVEL DOCUMENTS

The client must be in possession of a valid passport (for Indians a valid ID card) and all visas required for the whole of the journey and the client accepts responsibility for obtaining the same. Any information or advice given by the company on climate, clothing, baggage, special equipment, etc is given in good faith but without responsibility on the part of the company.

We will prepare your trek permit using the personal information that you send us with the trek application. You must bring your passports or ID cards with you and take them on the trek. If the information in your passport or your ID card is different from that provided in trek application, the government authorities will not allow you to start the trek and you will not be entitled to a refund.

Failure to bring the required travel documents will be treated as a cancellation of the trek by the client.

FACTORS OUTSIDE THE KT’S CONTROL

Kashmir Treks will do its best to minimize the effects of matters outside its control, but cannot accept any liability or additional associated costs, either directly or indirectly, for these matters which include political disputes, unforeseeable climate, road blocks, landslides on the treks or closure of the treks due to heavy snowfall on the mountain passes. If all or part of any trek is closed due to snowfall then KashmirTreks will do its best to provide an alternative trek itinerary. Unfortunately the trek deposit and balance (if paid) will not be refunded to clients if the trek is cancelled due to heavy snowfall and / or the client decides not to participate in an alternative trek although KT will provide clients with suitable documentation so that clients can claim a refund from their insurance companies.

RESPONSIBILITY

KT shall not be liable for any damage or loss if the failure to carry out the contract is: 1) attributable to the client 2) attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable 3) due to unforeseen and unusual circumstances beyond the company’s control, the consequences of which could not have been avoided even if all due care had to be exercised. 4) due to political disputes, climate or other matters of a similar nature. 5) due to an event which the company, even with all due care could not foresee or forestall. Any liability is limited to the full price paid for the tour. In all cases the company specifically excludes all liability for indirect or consequential loss or expense, including loss of profits.

CLAIMS AND COMPLAINTS

If a client has a complaint against KT the client must first inform the trek guide or company representative while on the tour in order that the guide/representative can attempt to rectify the matter. Any further complaint must be put in writing to the company within 7 days of the end of the tour.

LOCAL CONDITIONS

Due to political and cultural differences, as well as generally tougher physical conditions, travel to the areas we visit involves risks other than those we take in our daily lives. It is important clients make themselves aware of the risks involved, and are responsible for making their travel plans accordingly.

PHOTOGRAPHS

Our guides may take photographs in the course of their leading our treks. We may sometimes include these photos on our website, and some of these images may include our clients in the trekking. We will honor any request by a client to not have her or his photo so utilized, and we will also honor any request by any client to have her or his existing photo on the website removed from the website.

LINKS

Our website includes links to outside websites that are not managed by us. We include these for the purposes of offering our clients information or products that might enhance their trip experience and safety with KT. Also, we provide links to conservation organizations who we believe are effective at protecting wild country. We do not exercise control over the content of any of these websites. Although we try very hard to include links only to reputable companies or organizations, it remains possible that outside websites might place “cookies” or other software on your personal computer which may be undesirable. If you feel that any of the links that we’ve provided is inappropriate or has damaged your computer, please contact us so that we can take appropriate action.

At all times your contract will be with Kashmir Treks. The name Kashmir Treks is (licensed with Kashmir Tourism Department as KASHMIR ALPINE TREKS).
